Exotic Jet Incorporated. warrants that new Exotic Jet JetCar purchased from an authorized Exotic Jet dealer in the continental United States will be free from defects in material and workmanship for the period of time stated herein, subject to certain stated limitations.
PERIOD OF STRUCTURAL LIMITED WARRANTY. The hull and deck on any new Exotic Jet JetCar purchased for pleasure use from an authorized Exotic Jet dealer in the United States will be warranted against major structural defects for a period of two (2) years in pleasure use, or for one (1) year in commercial applications.
The warranty described here applies to JetCars purchased and registered for use in the United States only. For warranty provisions outside the United States, contact that particular country’s local Exotic Jet distributor.
PERIOD OF ENGINE LIMITED WARRANTY: The engine, engine related components, jet pump and jet drive pump related components (collectively defined as “Engine”) shall be warranted against defects in material or workmanship for a period of fifty (50) hours of use from the Date of Original Purchase for both Pleasure Use and Commercial Use.
PERIOD OF COMPONENT LIMITED WARRANTY. All other Exotic Jet JetCar components, except for components covered under the Structural Limited Warranty and the Engine Limited Warranty, will be warranted against defects in material or workmanship, for a period of six (6) months from Date of Original Purchase for Pleasure Use, or for a period of three (3) months for Commercial Use.
STRUCTURAL LIMITED WARRANTY TRANSFERABILITY FOR PLEASURE USE ONLY: To transfer the warranty from the original purchaser to the subsequent owner, the Exotic Jet JetCar must be inspected and the warranty registration transferred, by an authorized Exotic Jet dealer, within five (5) days after the second retail owner’s purchase. The transfer of the warranty is effective upon the date Exotic Jet receives electronic or written notice of the transfer, by an authorized Exotic Jet dealer. The warranty may only be transferred once to the second retail owner. Transfer of the Structural Limited Warranty is not permitted for Commercial Use Exotic Jet JetCars.
ENGINE, COMPONENT AND COSMETIC LIMITED WARRANTY TRANSFERABILITY: The engine, component and cosmetic warranty, can be transferred from the first retail owner to a second retail owner, provided the original retail owner’s warranty time period has not expired. The time period of the transferred warranty shall only be the time period remaining upon the date of transfer, and in no event shall the transfer of a warranty extend the original warranty time period. To transfer the warranty from the original purchaser to the subsequent owner, the Exotic Jet JetCar must be inspected and the warranty registration transferred, by an authorized Exotic Jet dealer, within five (5) days after the second retail owner’s purchase. OBTAINING REPAIRS UNDER WARRANTY: During the period of warranty, Exotic Jet, any of its authorized representatives, or any authorized Exotic Jet dealer, in the country of residence, will, free of charge, repair or replace, at Exotic Jet’s option and sole discretion, any parts adjudged defective by Exotic Jet due to faulty workmanship or material from the factory provided the owner return the Exotic Jet JetCar, with transportation prepaid to an authorized Exotic Jet dealer, or if necessary to the Exotic Jet factory or any other reasonable place designated by Exotic Jet. Should Exotic Jet elect (within their sole discretion) to replace the entire Exotic Jet JetCar, the replacement boat shall be subject to the remaining duration and conditions of this limited warranty and not be subject to an extended or new warranty unless otherwise provided for by both parties in writing. The liability of Exotic Jet shall in no event exceed the actual cash value of the covered item. The Exotic Jet JetCar owner shall be responsible for all transportation, haulouts, loss of time, inconvenience, travel expense, loss of use, launch, towing, storage and other expenses incurred in returning the Exotic Jet JetCar for warranty service. All parts replaced under warranty will become the property of Exotic Jet Incorporated.
CUSTOMER’S RESPONSIBILITY: Under the terms of this limited warranty, the customer will be responsible for ensuring that the Exotic Jet JetCar is properly operated, maintained, and stored as specified in the applicable Owner’s Manual. The owner of the Exotic Jet JetCar shall give notice to Exotic Jet, or its authorized representative, or Exotic Jet dealer of any and all apparent defects within five (5) days of discovery and make the JetCar available as directed for inspection and/or repairs.
GENERAL EXCLUSIONS FROM WARRANTY: This limited warranty will not cover the repair of damages to your Exotic Jet JetCar caused by abuse, alteration, modification, neglect, vandalism, failure to adhere to product capacity information and/or product maintenance, care instructions, and/or other items listed below. Examples of damage caused by abuse, alteration, modifications, neglect, vandalism, non-adherence and other items include, but are not limited to the following:
Racing or competition use, modification of original parts, abnormal strain.
Lack of proper maintenance and off season storage as described in the Owner’s Manual.
Use of lubricants, oils, and fuel/oil mixtures that are not suitable for marine engine use.
Damage as a result of accidents, collisions, contact with foreign materials, or submersion.
Damage caused by growth of marine organisms.
Damage caused by exposure to the elements and other deterioration resulting from normal wear and tear.
Gel coat stress cracks caused by impact.
Blisters in the gel coat.
Acts of God or force majeure.
Damage Caused by use of high pressure water toward the electronics of the Exotic Jet JetCar
Dealer preparation, including but not limited to cleaning and adjustments or alignments in preparing the boat for final delivery.
Windshield breakage.
Deterioration caused by the use of cleaners or chemicals or anti-fouling paint not recommended in writing by Exotic Jet.
Installation of accessories installed by anyone other than Exotic Jet or an authorized Exotic Jet dealer.
Damage resulting from non-compliance with Exotic Jet’s maintenance and care instructions or other specifications.
Galvanic or stray current corrosion, or corrosion caused by salt or brackish water.
Damage to colorfastness of materials caused by overexposure to the sun or improper covering and storage.
Failure of the Exotic Jet JetCar to meet any representation as to the Exotic Jet’s performance characteristics, including but not limited to estimated speed, weight of the Exotic Jet JetCar, or fuel consumption.
Failure or defect caused by repair made by a Exotic Jet dealer not authorized as a Exotic Jet dealer, unless Exotic Jet pre-approved the work in writing.
Damage caused by engines, jet pumps or jet pump components, controls, batteries, trailers, electric trolling motors, fish/depth finding devices, canvas, wakeboard tower, other equipment or accessories not manufactured by Exotic Jet whether or not warranted by other such manufacturer.
SPECIFIC PARTS EXCLUDED FROM WARRANTY: Parts replaced due to normal wear or routine maintenance such as, but not limited to, oil, spark plugs, fuel filters, impeller and liner, and anodes are not covered by warranty.
EXOTIC JET MAKES NO OTHER WARRANTY OF ANY KIND, EXPRESSED OR IMPLIED. ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WHICH EXCEED THE OBLIGATIONS AND LIMITS STATED IN THIS WARRANTY ARE HEREBY DISCLAIMED BY EXOTIC JET AND EXCLUDED FROM THIS WARRANTY.
ALL EXOTIC JET JETCARS PURCHASED AND/OR REGISTERED FOR USE OUTSIDE THE 50 U.S. STATES ARE SOLD AS IS – NOTHING ELSE IS PROMISED OR IMPLIED.
SOME STATES/PROVINCES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. THIS WARRANTY DOES NOT COVER ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES INCLUDING LOSS OF USE, LOSS OF TIME, AND INCONVENIENCE. EXOTIC JET’S LIABILITY IS LIMITED TO REPAIRING OR REPLACING THE EXOTIC JET JETCAR AS PROVIDED IN THIS WARRANTY. SOME STATES/PROVINCES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES. SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE OR PROVINCE TO PROVINCE.
THIS DOCUMENT CONTAINS THE ENTIRE WARRANTY GIVEN BY EXOTIC JET AND THERE ARE NO TERMS, PROMISES, CONDITIONS OR WARRANTIES OTHER THAN THOSE CONTAINED HEREIN. NO ORAL OR WRITTEN INFORMATION OR ADVANCE GIVEN BY EXOTIC JET, ITS DEALERS, REPRESENTATIVES, AGENTS OR EMPLOYEES SHALL CREATE A WARRANTY BY EXOTIC JET OR IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY.
